*--An Automobile accident in the Bowling Green, Ohio area resulted in the death of a mother of 4 children, we obtained a $1 million wrongful death settlement award in this case for the family through negotiations with the auto insurance company. We established wrongful death trusts to manage the settlement dollars awarded to the minor children, and handled the probate and taxation filings, to bring the process to finality for this family.
*--Lutheran Home at Wolf Creek, a nursing home located in Holland, Ohio, is a joint venture of Lutheran Homes Society and St. Luke's Hospital, in Maumee, Ohio - our client's loved one died as a result of an injury sustained while a resident of Lutheran Home at Wolf Creek. A staff member of Lutheran Home was placing her in a hoist to bathe her when she dropped to the floor, breaking her femur. She was treated for her injuries at St. Luke's Hospital and later died as a result of her injuries. Her death certificate stated she died of the blunt forced trama, as a result of the fall, and we were able to show they violated protocol by only one staff member attempting to lift her, when their protocol requires two staff. As a result, we negotiated a monetary settlement with the insurance company resulting in a wrongful death settlement award to the family.
*- more than a year after we obtained the settlement and closed the case, St. Lukes Hospital attempted to bill the family for medical services. We represented the family to avoid this late filed invoice and wrote St. Luke's to inform them that they missed the probate creditor claim statute which states claims against Estates must be filed within 6 months of death, and that deadline had long past.
